PTAB Designates Decision as Precedential

The United States Patent and Trademark Office’s (USPTO) Patent Trial and Appeal Board (PTAB) on May 5, 2020, designated as precedential Apple Inc. v. Fintiv, Inc., IPR2020-00019, Paper 11 (March 20, 2020). This order discusses six factors the Board considers in determining whether to exercise its discretion to institute review when there is a related proceeding pending in district court.

The PTAB also de-designated Oracle Corp. v. Click-to-Call Techs. LP, IPR2013-00312, Paper 26 (Oct. 30, 2013). This decision has been de-designated in view of the Board’s Precedential Opinion Panel (POP) decision in GoPro, Inc. v. 360Heros, Inc., IPR2018-01734, Paper 38 at 8-9 (PTAB Aug. 23, 2019).
