"There are few trial lawyers in the exclusive world of Silicon Valley high-tech circles as trusted as Daralyn Durie,” says Lawdragon’s 500 Leading Lawyers in America. Daralyn has been selected by Benchmark Litigation as one of the top 20 trial lawyers in California and one of the top 100 trial lawyers in the United States, Chambers & Partners as one of the top 6 patent litigators in California, Superlawyers as one of the top 10 lawyers in Northern California, the Daily Journal as one of the top 100 lawyers and one of the top 75 intellectual property lawyers in California, and by Law360 as an Icon of IP and MVP. Benchmark Litigation reports that "Going against her was like going against a boxer in which you know you're going to get hurt."
Daralyn served as lead counsel for Genentech in a series of cases enforcing the Cabilly family of patents, which generated billions in licensing revenue, as lead counsel in high stakes biosimilar litigation over one of Genentech’s most successful products, and successfully defended Google against claims of copyright infringement arising from the scanning of works in major library collections, resulting in her being named one of California Lawyer Magazine’s Attorneys of the Year. Recently, she scored wins in the Federal Circuit (on behalf of a law firm client that had been hit with an over $500,000 sanction award), the Ninth Circuit (defending summary judgment in a case of first impression on liability for allegedly removing copyright management information), in the PTAB (upholding key patents protecting Genentech blockbuster drugs from biosimilar entry), and in the California Court of Appeals (defending a trial win for the California State University in a class action brought by 170,000 students challenging fee increases as double billing).
Following law school, Daralyn clerked for the Honorable Douglas Ginsburg on the United States Court of Appeals for the District of Columbia Circuit. She then began work at Keker & Van Nest as an associate, and became a partner of the firm in January 1999. Daralyn co-founded Durie Tangri in 2009. Daralyn is a fellow in the American College of Trial Lawyers, a past President of the Board of Directors of the Northern California Association of Business Trial Lawyers, a former co-chair of the Lawyer Representatives to the Ninth Circuit Judicial Conference, and a court-appointed Early Neutral Evaluator for the Northern District of California. She won the American Bar Association’s closing argument competition at its annual litigation section meeting, besting three of the top litigators in the country. She has testified before the Federal Trade Commission, speaks frequently on intellectual property issues, and is a co-author of a two-volume practice guide on California civil trials. In her free time, she can be found riding on two wheels around California and beyond.
