June 20, 2023 - The American Intellectual Property Law Association (AIPLA) submitted comments to the United States Patent and Trademark Office in response to its Advance Notice of Proposed Rulemaking published in 88 Fed. Reg. 77, at 24503 (April 21, 2023) (ANPRM) on “Changes Under Consideration to Discretionary Institution Practices, Petition Word-Count Limits, and Settlement Practices for America Invents Act Trial Proceedings Before the Patent Trial and Appeal Board.” -

Supreme Court Rules Andy Warhol Foundation Violates Copyright in Andy Warhol Foundation for the Visual Arts, Inc. v. Goldsmith

On May 18, 2023, the Supreme Court ruled that the Andy Warhol Foundation (AWF) violated Lynn Goldsmith’s copyright. As advocated in AIPLA’s Amicus Brief filed on June 17, 2022, the Court confirmed that a fair use analysis involves weighing all the statutory factors, and that a fair use analysis is an objective inquiry. Supreme Court Unanimously Upholds Federal Circuit’s Decision in Amgen Inc. v. Sanofi

On May 18, 2023, the Supreme Court unanimously upheld the U.S. Court of Appeals for the Federal Circuit’s decision finding Amgen’s patent invalid. This ruling is consistent with the amicus brief filed by AIPLA on February 10, 2023. To read the opinion of the Court, please click here. -
Supreme Court Vacates and Remands the Lower Court's Ruling in Jack Daniel’s Properties Inc. v. VIP Products LLC

April 26, 2023 - AIPLA co-hosted a standing-room only event in honor of 2023 World Intellectual Property Day on Wednesday, April 26, 2023, to celebrate this year’s theme – Women and IP: Accelerating Innovation and Creativity. We were pleased to be joined by both congressional leaders on IP issues, Sen. Chris Coons, Chair of the Senate Judiciary IP Subcommittee, and Rep. Darrell Issa, Chair of the House IP Subcommittee. Sen. Mazie Hirono generously sponsored the event on Capitol Hill. -

AIPLA's Women in IP Law Committee Hosts Global Networking Event

On April 27, 2023, AIPLA's Women in IP Law Committee hosted the 2023 Women in IP Law Global Networking Event. The theme for this year’s event was: Owning Your Voice, as an encouragement for women to fill up their space and speak up their role in the profession. Over 60 cities worldwide participated in the event, and most locations hosted live in-person meetings. -
AIPLA Comments on Federal Trade Commission Non-Compete Clause

The proposed rule would effectively ban the use of non-competes, with few exceptions. -

AIPLA Advocacy Leads to USPTO Withdrawal of CLE for Patent Practitioners

On January 26th, 2023, the USPTO adopted the interim final rule, without change, that was published in the Federal Register on November 14, 2022. The final rule eliminates the provisions of the Code of Federal Regulations related to voluntary continuing legal education (CLE) certification and recognition for registered patent practitioners and individuals granted limited recognition to practice in patent matters before USPTO. -
